1. General Provisions
1. These Regulations apply to all individual and institutional users utilizing the Over-the-Counter (OTC) services of Ekbit Exchange.
2. Prior to using OTC services, users shall fully understand the platform rules, risk warnings, and corresponding legal obligations.
3. By accessing or using OTC services, the user is deemed to have accepted these Regulations and all other related terms of the platform.
2. User Eligibility Requirements
1. Only users with full civil capacity are permitted to use the OTC services.
2. Users must complete identity verification (KYC) and ensure that all submitted information is true, lawful, and valid.
3. Ekbit reserves the right to suspend or terminate OTC access for users who provide false information, fail compliance checks, or do not meet regulatory requirements.
3. Account and Security Management
1. Each account is for the exclusive use of the registered user and may not be lent, leased, sold, or operated by any third party.
2. Users shall properly safeguard their login credentials, authentication methods, and payment account information.
3. Losses arising from account compromise, password leakage, or user negligence shall be solely borne by the user.
4. The platform may restrict, freeze, or conduct reviews on accounts displaying suspicious or abnormal activity in accordance with risk management requirements.
4. OTC Trading Rules
1. Users shall ensure their funds originate from lawful sources and that their trading intentions comply with applicable laws and regulations.
2. Users must strictly adhere to the following requirements during OTC transactions:
• No falsified transactions, wash trading, or involvement in illegal fund flows;
• No use of payment accounts not registered under the user’s verified identity;
• No solicitation of offline or private transactions outside the platform;
• No submission of fake payment proofs or fraudulent appeals;
• No malicious payment delays or refusal to release assets;
• No behavior disrupting the normal market order of the platform.
3. Users shall ensure the accuracy of payment details and complete payments within the required time.
4. For failure to make timely payments or violations during order processing, the merchant may cancel the order, and the platform may impose restrictions.
5. Payment Account Management
1. All payment or receiving accounts used in OTC transactions must be real-name, lawful, and owned by the user.
2. The use of accounts with unclear sources, borrowed accounts, third-party accounts, or proxy payment accounts is strictly prohibited.
3. The platform reserves the right to review, restrict, or freeze accounts involved in suspicious payment activities.
6. Order Handling Requirements
1. When initiating a buy order, users shall complete payment within the specified timeframe and upload valid payment proof when required.
2. When executing sell orders, users shall verify the incoming payment and release assets promptly upon confirmation of receipt.
3. If orders remain unprocessed due to user negligence or misconduct, the platform may intervene or impose penalties accordingly.
4. Users must maintain appropriate communication ethics and shall not insult, harass, threaten, or abuse merchants or other users.
7. Compliance and Risk Control Obligations
1. Users must comply with Anti-Money Laundering (AML), Counter-Terrorism Financing (CTF), and other applicable compliance requirements when using OTC services.
2. Users shall cooperate with the platform when required to provide explanations regarding transaction purposes, fund sources, or transaction records.
3. If a user refuses to comply with compliance checks or displays high-risk behavior, the platform may:
• Restrict OTC trading permissions;
• Freeze accounts or assets;
• Suspend or terminate services;
• Report suspicious activities to relevant authorities.
8. Violations and Penalties
If a user violates these Regulations, the platform may impose one or more of the following measures:
1. Warning or reminder;
2. Restriction of OTC trading permissions;
3. Freezing of account or assets;
4. Limitation of withdrawal or payment functions;
5. Permanent revocation of OTC access;
6. Account suspension or termination;
7. Reporting to legal or regulatory authorities for suspected unlawful activities.
Users shall bear full liability for any damages caused to the platform or other parties due to their violations.
9. Account Termination or Discontinuation
1. Termination of OTC usage does not affect the applicability of these Regulations.
2. Before requesting account closure, users must ensure:
• No pending OTC orders;
• No unresolved disputes or complaints;
• No outstanding violations awaiting review.
3. For compliance or risk-related concerns, the platform may suspend or refuse the user’s account closure request.
10. Supplementary Provisions
1. These Regulations are formulated by Ekbit Exchange, which retains the final right of interpretation.
2. The platform may amend or update these Regulations at any time in accordance with business needs or legal requirements and will publish the revised version.
3. Continued use of OTC services constitutes acceptance of the updated terms.
